Malawi President Professor Peter Mutharika has homophobic Nyakwawa Usiwa-Usiwa as a Judge of the High Court.
According to Press Statement released on Wednesday signed by Chief Secretary to the President George Mkondiwa the appointment is with immediate effect.
“…in exercise of the powers conferred upon him by section 111 sub section (2) of the Constitution of the Republic of Malawi, has appointed His Honour Nyakwawa Usiwa-Usiwa as a Judge of the High Court,” reads in part the statement.
Judge Nyakwawa, was the first judge in Malawi to convict and sentence the first gay couple in the country Steven Monjezaand Tiwonge Chimbalanga in the year 2010. The two were slapped with 14 years in imprisonment with hard labour.
In his sentence, Judge Nyakwawa told a fully parked court that homosexuality is against the Malawian culture and tradition,
“I will give you a scaring sentence so that the public be protected from people like you, so that we are not tempted to emulate this horrendous example….
“We are sitting here to represent the Malawi society, which I do not believe is ready at this point in time to see its sons getting married to other sons or conducting engagement ceremonies,” quoted Nyakwawa.
Later, the two convicts were pardon by the former president late Bingu Wa Mutharika donors threatened to cut aid.
Meanwhile some quarters have described the appointment of Usiwausiwa as replacement for Justice George Bakuwa who died while on duty in Zambia last month.
In October this year, the president appointed four new judges, namely Joseph Chigona, Ruth Chinangwa, Dorothy De Gabrielle and George Bakuwa, who died while on duty in Zambia last month, barely a month after his appointment.
